Hey guys, I am wondering if we have to pay HST for last month rent deposit? The story is we hired an agent to find tenants for our rental. She did find a tenant who subsequently gave her first and last month deposit. Her commission is first month rent which she got and she cut us a cheque for last month rent minus the HST because it is considered part of the commission because she represented both sides us the landlords and the tenants, or so she said.
This is our first rental so I am a bit fuzzy on the rules. I did a forum search and some Googling but did not find anything concrete. Thanks for your feedback. The HST is not a big amount and we will be glad to pay it if that is what the rule say I'm a student. What gives? Are banks aggressively soliciting right now or something? We rented our place out to these couple with 4 kids in December I had them bring in there bank account statement to show regular income and guaranteed deposit from the govt. Everything looked great on paper. Then problem started coming in. They will give us a check for the time it was due but when we take the check to the bank for certification they will refuse it.
I will call the renter and he will make up some excuse and send me etransfer of partial rent and pay the rest over couple of week. This month same issue and I told him that I will need etransfer. The renter goes extremely aggressive and tells me to give him '2 week notice'. I told him we would like to meet him in person and work out a deal I in all honesty wanted him to leave and give him his partial deposit back for the last month but the tenant kept on dodging the time to meet for two days until last night when he texts me that I didn't show up.
I told him that I would have come if he would have cofirmed the time of meeting which he didn't and that I will be dealing with this tomorrow it was already quarter to After which he sends us an extremely aggressive text that we shouldn't be threatening him and that he will call the cops on us and will also contact his lawyer and that his wife doesn't feel safe around me? Anyways we are thinking of hiring an eviction company to deal with this.
Can anyone tell me if they have faced similar situation? We have never even charged these guys late rent charges and always gave them leway and accepting there excuses and now this. Also is hiring an eviction company is the way to go?

As for the deposit feature, I like the simplicity of this compared to the Tangerine one that always tells me my picture is too blurry. Is it like TD where you need to sign the back of the cheque, or like Tangerine, where you don't need to?
